DePuy Hip Implant Recall
A previous recall of the DePuy ASR XL Acetabular Hip and ASR Hip Resurfacing System has prompted patients to inquire about their DePuy Pinnacle problems. While the Pinnacle Acetabular Cup System was not a part of the August 2010 DePuy hip recall, the design of the metal-on-metal Pinnacle hip is somewhat similar to the recalled DePuy ASR Systems and may also lead to DePuy hip problems for patients. Like the ASR hip replacements included in the 2010 DePuy hip implant recall, this Pinnacle system can be used with metal-on-metal components.
Reportedly, metal-on-metal hip devices can wear, releasing microscopic particles into the patient’s body. Some patients experiencing DePuy Pinnacle problems have reported severe inflammatory reactions or metal poisoning due to high levels of cobalt and chromium in their systems. Elevated levels of chromium and cobalt have been linked to the metal debris released by the metal-on-metal Pinnacle hip replacements. Metal poisoning symptoms in the patients were commonly associated with other problems, such as trouble walking, pain and swelling.

On April 5th, there was a hearing in front of Judge David A. Katz of the U.S. District Court for the Northern District of Ohio, who has been assigned the multidistrict litigation regarding the DePuy ASR lawsuits. A day later, Judge Katz issued three orders regarding the litigation, perhaps most notably an Explant Preservation Order.
Explant Preservation Order Issued Against DePuy
A preservation order is a judicial mandate creating a duty to preserve certain “documents, data, and tangible things” related to the litigation. Judge Katz’s order was specifically regarding the defective ASR components removed from patients after the recall.
The order spans nine pages and explains in great detail the procedures that must be followed by both DePuy and the respective plaintiffs following surgery. The explanted device and surrounding tissue that is removed from a patient whose device is subject to the recall are critical pieces of evidence to any claim against the manufacturer. Judge Katz mandated that not only must the devices be preserved “with no additional damage,” but upon the plaintiff’s request hospitals are directed to preserve any synovial fluid or blood removed during the procedure.
Blow to DePuy Strategy
This is a blow to the strategy that has been employed by DePuy since the recall was first issued back in August of 2010 and litigation became imminent. Since issuing that recall, the company has asked patients and surgeons to return all explanted devices to the company. Doing so would be a mistake for people seeking legal restitution, as the defective device is excellent first hand evidence of DePuy’s negligence.
Now, fortunately with the issuance of Judge Katz’s Preservation Order, DePuy will no longer be able to coerce patients to giving up their explanted device.
There has been a full DePuy hip recall of both the ASR XL Acetabular Hip System and the ASR Hip Resurfacing System.
